HOUSE RULES Revised 3-19-2026
GENERAL RULES INCLUDING OCCUPANCY, LANAIS, COMMON AREAS
The provisions of these House Rules apply equally to all owners and occupants of units at the Hale Ono Loa condiminium project ("Project"). The term "occupant" includes any opwner, their tenants, family members and other persons residing at the Project. The term "guest" includes an occupant's agents,, invitees, licensees, employees, contractors, vendors, and other visitors. All owners are responsible for the actions and conduct of any occupant in their units and any guests.
1. Registration: All occupants and guests must register in Hale Ono Loa's official registration system (as may be established by the Board) upon arrival at the Project. Owners shall be responsible for ensuring their occupants register. Any owner that does not reside on Maui and is renting their unit must provide the name and contact information for the owner's local agent. Owners are responsible for updating the registration information when changes occur. Failure to register or update this information may result in the assessment of fines.
2. Vehicle Registration: All occupants and guests must register their vehicle in Hale Ono Loa's official registration system (as may be established by the Board) upon arrival at the Project by providing their name, contact informatio , and vehicle information (i.e., license plate number, make, model and color of vehicle). Failure to register a vehicle may result in the assessment of fines.
3. No occupants shall use any portion of the common areas for their exclusive use and/or for the purposes other than those for which the area was intended, including, but not limited to, walkways.
4. Excessive or unreasonable noises by any occupants are not permited.
a. A “QUIET TIME” between the hours of 10 PM and 8 AM, daily. The courtyard, BBQ grills, and sundecks are not accessible during these hours. The pool can be used for quiet exercise at 8 AM and opens at 9 AM for general use.
b. Occupants shall neither make nor permit any unreasonably loud or disturbing noises, including that from electronics, voices or musical instruments, in the units or common areas, nor permit anything to be done that will interfere with the rights, comforts and convenience of other occupants. This rule applies 24/7.
c. Construction involving loud noises such including but not limited to sawing tile or wood, loud hammering or pounding, using a loud compressor, etc. is only allowed between the hours of 8 AM and 6 PM, Monday through Friday, and on Saturdays between 8 AM and 12 PM (noon), except in an emergency. No such construction activities are permitted on Sundays or Federal Holidays, except in an emergency. Tile cutting or other construction that causes dust or odors must be done within the confines of the unit, with all doors and windows closed. No unauthorized construction is permitted in the common areas. The owner hiring the contractor is responsible for ensuring that the contractor removess all construction residue daily, at their expense. Contractors may not dispose of construction material in the common areas or trash facilities.
5. Walkways are provided for access to the pool area. Accessing or leaving from the pool area by climbing over or jumping off the retaining walls separating the pool area from the 1st floor units is not allowed. The lawn areas above the retaining walls and in front of the 1st floor units are not be used as an access path for any purpose.
6. Cleaning and maintenance of units shall be accomplished at such times and in such a manner as not to interfere with other occupants’ enjoyment of their own units/or common areas. Unreasonable noise from such activities is prohibited between 10 PM and 8 AM, daily.
7. Damage to the Asociation buildings and/or its equipment or systems resulting from improper use, negligence, or as a result of moving and/or carrying of articles therein, shall be paid for by the occupant, owner or the person responsible. Owners are ultimately responsible for any damage caused by their occupants and/or guests.
8. Lanai railings shall not be used for the shaking out of items or drying of laundry, bathing suits, beach towels or other items. Personal items are not to be stored in the open on lanais. Items too large or bulky to be stored in units may temporarily be stored in areas designated by the Resident Manager (e.g., kayaks, surfboards, and paddle boards may be stored in the rack behind the Napili wing). Please contact the RM.
9. Storage of household items, furnishings and/or construction material on the common elements is not permitted Such items may be stored on the lanais during periods of construction only with prior written permission of the Resident Manager. The Resident Manager must be notified in advance and must be given the planned period that the items will be stored on the lanais. All items must be neatly organized and covered with a green or brown drop cloth or tarp so that the items are not visible to the public.
10. All Association employees, including but not limited to landscapers and others, have been instructed to take directions only from the Resident Manager. Do not ask them to perform tasks. All requests must come through the Resident Manager.
11. The number of persons residing in any unit must confrom to all applicable Federal, State, County laws, regulations and ordinances. No occupancy levels will be enforced in any manner that would constitue a violation of the Federal Fair Housing Act or Hawaii Revised Statutes Chapter 515, as the same may be amended from time to time, or any successors thereto.
12. The Resident Manager may enter a unit without prior notice in the event of an extreme emergency, e.g., FLOODING, FIRE, SERIOUS CRIME, SEVERE INJURY, ETC.
13. No objects or debris shall be thrown or swept over the lanais or walkways.
14. PARKING RULES
a. Hale Ono Looa's parkiong lot is for the sole use of the occupants and their guests. There are a total of 67 parking spaces and each unit is entitled to only ONE PARKING STALL.
b. A VALID PARKING PLACARD/PARKING PASS MUST BE DISPLAYED AT ALL TIMES FOR ANY VEHICLE PARKED AT THE PROJECT.FAILURE TO DO SO MAY RESULT IN FINES AND/OR TOWING OF VEHICLES.
c. Each owner will be issued one (1) official parking placard/parking pass. Owners or owner's authorized agents, must personally pick-up the parking placard/parkingpass from the RM. The number on the parking placard/parking pass will be associated the each owner's unit (although to preserve the security of the owners, the parking placard.parking pass numbers will not be the unit number.
d. If an owner loses the parking placard/parking pass, the owner or owner's authorized agent may request a replacement from the RM. The owner shall be responsible for any costs associated with obtaining a replacement parking placard/parking pass.
e. OWNERS ARE SOLELY RESPONSIBLE FOR ENSURING THAT THEIR OCCUPANTS AND/OR GUEST PARKING AT THE PROJECT HAVE ACCESS TO THE VALID PARKING PLACARD/PARKING PASS ASSOCIATED WITH THEIR RESPECTIVE UNIT. It is not the Associations's responsibility to provide the owner's occupants and/or guests with a parking placard/parking pass.
f. Since each owner will be issued only one (1) parking placard/parking permit, owners who wish to park more than one vehicle at the Project may inquire whether other owners are willing to allow temporary use of their parking placard/parking permit during periods when they or their occupants are not parking a vehicle at the Project.
g. To help ensure that the use of our parking facility is limited to occupants and their guests, the Board has posted signage in accordance with Hawaii Law (HRSA 290-11) at the entrance to the parking lot notifying persons entering that any vehicle that is not authorized or does not display the approved parking placard/parking pass may be towed at the expense of the vehicle owner.
h. As a reminder, all occupants and guest must register their vehicles in Hale Ona Loa's official registration system (as mey be established by the Board) upon arrival at the Project by proving their name, contact information and vehicle information (i.e., license plate number, make, model and color of the vehicle). Failure to register a vehicle may result in fines as established in the Fining Resolution.
i. All vehicles parked at Hale Ono Loa's parking lot must hold a current valid registration with the DMV or have written proof that registration is pending.
j. No storage of inoperable (i.e,. non-functional) vehicles is allowed.
15. To help avoid personal injury and damaged vehicles, recreation activities of any sort in the driveway, elevator, stairways, and parking areas are prohibited.
16. No pets, livestock, poultry, rabbits or other animals shall be allowed or kept in any part of the project.
17. Notwithstanding anything to the contrary in the Declarationm By-Laws, or House Rules, animals upon which a disabled occupants an/or guests depend for assistance ("assistance animal") shall be permited to be kept by such occupants and/or guests in their units and shall be allowed on the common elements while under the control of the animal's handler/owner by use of a harness, leash, tether, cage or other physical control. If the nature of the person's disability makes physical control impracticable, or physical control would interfere with the assistance that the animal provides, the animal must be otherwise under the control of the animal's owner or handler by voice control, signals or other effective means.
If an assistrance animal causes a nuisance or unreasonable disturbance or posses a threat to the health or safety of any occupant or guest, the owner thereof will be given the opportunity to rectify the problem by measures which fall short of ejectment of the animal from the Project. Ejectment will be required only if the Board resonable determines that less drastic alternatives have been unsuccessful, If such an animal is ejected, it may nonetheless be allowed to find a suitable replacement animal, provided that the problem is controlled to a sufficient degree that the continued presence of the animal during that time does not constitute and unreasonable imposition upon, or threat to the safety or health of other occupants or guests.
Please contact the Association's Resident Manager if you need to request a reasonable accommodation for an assistance animal.
18. For health and safety reasons, feedin birds or any other feral animal on property is prohibited.
19. Smoking is prohibited throughout the project, as that term is defined in the Declaration; however, that smoking may be permited in any designated smoking areas. If any, as may be estrablished by the BOD from time to time. The Project includes all of the land and i,provements, including the common elements, the limited common elements, the apartments, and all lanais.
"Smoking" means inhaling, exhaling, burning, or carrying any lighted or heated tabacco product or plant product intended for inhalation in any manner or in any form. "Smoking" includes the use of electronic products that can be used to aerosolize and deliver nicotine or other substances to the person inhaling from the device, including but not limited to electronic cigarettem electroinic ciagar, electronic cigarillo, electronic pipe, hookah pipe, or hookah pen, and any cartridge or other component of the device or related product, whether or not sold separately.
The current designated smoking area is at the North end of the parking lot, with a bench and cigarette butt receptacle just inside the entrance by the Hale Ono Loa sign.
20. Vehicles may be washed from 9 AM to 6:30 PM at the South end of the parking lot in the area provided. Except for minor repairs that can be completed within four (4) hours and emergency repairs, vehicle repairs at the Project are prohibited. Routine maintenance including but not limited to fluid changes, is prohibited.
21. Lockout requests made to the Resident Manager between 8 AM and 5PM will result in a $50 charge to the owner's account. Requests made between 5 PM and 8 AM will result in a $100.00 charge to the owner's account.
22. BBQing is only allowed on gas barbeques in the pool area that are provided for occupant use. Please make sure that you have read the instructions before using and that you turn off the main gas valve when finished with your cooking. The grill surface must be cleaned after use. Gas BBQs are available 9 AM to 10 PM. No hibachi, grill or other similar devices used for cooking, heating, or any other purpose maybe used or kindled on any lanai, under any overhanging portion or within ten (10) feet of any structure.
23. No person shall use, operate, launch or land any drone on or over the common elements of the Project, except with prior written approval of the BOD. As used in these House Rules, "drone" is defined to include, without limitation, any: unmanned aircraft system (UAS), which means an aircraft that is operated without direct human intervention from within or on the aircraft, and associated elements including communication links and componenets that control the unmanned aircraft; unmanned aerial vehicle (UAV); remotely piloted aerial vehicle; unpiloted aerial vehicle; and model aircrat (remote controlled model aiorplanesm helicopters, etc.).
POOL USE
24. The pool area (pool, shuffleboard, BBQ, etc.) is for the EXCLUSIVE USE of Hale Ono Loa occupants and guests. The pool area is open from 9 AM to 10 PM daily.
a. Nude bathing is not allowed. Appropriate swimwear must be worn by all persons entering the pool.
b. Persons who are incontinent shall not use the pool unless they wear swim diapers or other leak-proof garments designed to prevent contamination of the pool.
c. Occupants are responsible for the safety and conduct of their guests.
d. No screaming, loud behavior, pushing, running, fighting, boisterous or rough play, excessive noise, etc. will be permitted. No diving permitted.
e. Lifeguard services are not provided. Persons who are not competent swimmers shall not be permitted in the swimming pool, unless supervised and accompanied by a competent swimmer who shall be responsible for the non-swimmer's conduct and safety.
f. ABSOLUTELY NO GLASS IN OR AROUND THE POOL.
g. The pool game "Marco Polo" is prohibited.
h. Any person having an infectious or communicable disease shall be excluded from the pool. Persons having any open blisters, cuts, etc., shall be warned that are likely to become infected and advised not to use the pool.
i. Spitting or spouting of water, blowing of the nose in the pool, unsanitary discharge, urinationg in the pool etc. is strictly prohibited.
j. For the safety of all, pool gates must be closed and locked when entering and leaving the pool area.
k. A restroom is provided off the lobby in the Napili wing. The pool key opens that door.
l. All persons using the swimming pool shall take a cleansing shower before entering the pool. A bather leaving the swimming pool to use the toilet shall take a second cleansing shower before returning to the pool.
m. The swimming pool shall be immediately closed for cleaning in the event of an accidental fecal or vomit disharge. All bathers shall be ordered to leave the swimming pool until such substances are removed.
n. Pets are not allowed in the swimming pool.
BUILDINGS AND OTHER MODIFICATIONS
25. Unless the Board gives prior written approval in each instance, occupants shall not install or operate on the premises any machinery or electrical apparatus not classified as a household appliance.
a. Absolutely no air conditioners are to be installed without obtaining at least prior written approval from the BOD.
b. No storage and/or use of any flammable or explosive material, not classified as a household product is permitted, provided that gasoline in a vehicle's gas tank is permitted.
c. Draperies, curtains or other material placed against any windows or doors visible from the exterior shall be off-white or beigh-toned.
d. Lanai sunshades must be beige-toned Lanai sunshades must be properly maintained. The lanai sun shades must be pulled up and secured at night. The RM reserves the right to remove damaged or worn-out sunshades.. The shades must be pulled up and secured at night. The Resident Manager reserves the right to remove damaged or worn out shades.
e. Washing machines or dryers are not allow in the unit.
LANDSCAPING
26. Owners shall not engage in any lanscaping activities on the common elements unless authorized in wriging by the RM or Landscape Committee Chairperson. Owners are not permitted to plant trees, shrubs, fruit, vegetables or ornamental plants/grass on the common elements. No pruning branches or cutting flowers for individual usage. The Landscape Committee has occasional pruning parties and also rehabilitates specific areas that need attention. All owners are encouraged to join and we we will be sending out bulletins informing owners of these events. The landscaping is for all owners to enjoy as a community.
