HALE ONO LOA ASSOCIATION OF APPARTMENT OWNERS 

HOUSE RULES


GENERAL RULES INCLUDING OCCUPANCY, LANAIS, COMMON AREAS

 

1. No Owner, Tenant or Guest shall use any portion of the common area for their exclusive use and/or purposes other than those for which the area was intended including walkways.

 

2.  Excessive noises by any Occupant(s) (NO EXCEPTIONS) are not permitted. 

The Resident Manager will enforce the following:

 

a.      A “QUIET TIME” between the hours of 10PM and 8AM, daily.  Occupants shall neither make nor permit any loud or disturbing noises, including that from electronics, voice or musical instruments, in the units or common areas nor permit anything to be done by such persons that will interfere with the rights, comforts and convenience of other occupants.

b.      Construction involving disturbing noises such as sawing tile or wood, loud hammering or pounding, using a loud compressor, etc. will only be allowed in the units between the hours of 8AM and 6PM, Monday through Friday.  No such construction activities are permitted on Saturdays, Sundays or holidays.  Tile cutting or other construction that causes dust or odors must be done in the unit with all doors and windows closed.  No construction is permitted in the common areas.  The owner will inform the contractor of the requirement to sign in daily on a register in the lobby.  The owner hiring the contractor is responsible for having the contractor remove construction residue daily at their expense.

 

3.  Walkways are provided for access to the pool area. Accessing or leaving from the pool area by climbing over or jumping off the retaining walls separating the pool area from the 1st floor units is not allowed. The lawn areas above the retaining walls and in front of the 1st floor units are not be used as an access path for any purpose.

 

4.  Cleaning and maintenance of units shall be accomplished at such times and in such a manner as not to interfere with other occupants’ enjoyment of their own premises and/or the common area.  Noise from such activities is prohibited between 10PM and 8AM.

 

5.  Damage to the building and/or its equipment or systems resulting from improper use, negligence, or as a result of moving and/or carrying of articles therein shall be paid for by the occupant or the person responsible.

 

6.  Lanai railings shall not be used for the shaking out of items or drying of laundry, bathing suits, beach towels or other items. Personal items are not to be stored in the open on lanais.  Items too large or bulky to be stored in units can be stored in areas designated by the Resident Manager.  Storage of household items and furnishings outside the unit during any period of construction is allowed with permission of the Resident Manager.  The Resident Manager will be notified in advance and will be given the planned period that the material will be left outside. All material will be neatly organized and covered with a green or brown drop cloth or tarp so that the material is not visible to the public. Blue tarps are not allowed. All material shall be stored only on the unit’s lanai or concrete patio area.

7.  All employees including landscapers and others have been instructed to take direction only from the Resident Manager.  Do not ask them to perform tasks.  All requests must come through the Resident Manager.

 

8.  Unit occupancy of 1bedroom units is limited to a maximum of 4 individuals for VACATION RENTALS and a maximum of 2 for long term rentals.  Unit occupancy of 2 bedroom units is limited to a maximum of 6 individuals for VACATION RENTALS and a maximum of 4 for long term rentals.

 

9.  The Resident Manager may enter a unit without prior notice in the event of an extreme emergency, i.e. FLOODING, FIRE, SERIOUS CRIME, SEVERE INJURY, ETC.

 

10. No objects or debris shall be thrown or swept over the lanais or walkways from the 2nd, 3rd or 4th floors.

 

11.  Each unit is entitled to ONE PARKING STALL, and each Owner, Tenant or Guest MUST OBTAIN A PARKING PERMIT FROM THE RESIDENT MANAGER.  Such permit must be displayed as directed by the Resident Manager.  Any vehicle that is not authorized or does not display the approved permit will be towed away at the expense of the Owner, Tenant or Guest. 

 

12. To avoid personal injury and damaged vehicles, recreation activities of any sort in the driveway, elevator, stairways, and parking areas are prohibited.  No bouncing of balls in the walkways or on the grounds.

 

13. No pets, livestock, poultry, rabbits or other animals shall be allowed or kept in any part of the project.

 

14. For health and safety reasons, feeding birds or any other animals on property is prohibited.

 

15.     Smoking is prohibited at Hale Ono Loa within 20 feet of any door, window or airshaft, in accordance with State law. Smoking is also prohibited in any common or limited common area, except those provided for the use of those who smoke. The current smoking area is at the North end of the parking lot, with a bench and cigarette butt receptacle just inside the entrance by the Hale Ono Loa sign. Future changes, if any, will be posted by the resident manager. Fines will apply.

 

16. Vehicles may be washed from 9AM to Sunset at the South end of the parking lot in the area provided.  Repairs to vehicles on property are not permitted.  Resident Manager may waive this on a case by case basis.

 

17. Lockout requests made to the Resident Manager between 8AM and 5 PM will result in a $50.00 charge to the owner’s account.  Requests made between 5PM and 8AM will result in a $100.00 charge to the owner’s account.

 

18.     Barbequing is only allowed on the gas barbeques in the pool area that are provided for guest use. Please make sure that you read the instructions before using and that you turn off the main gas valve when finished with your cooking. Please clean the grill surface for the next guest. Gas barbeques are available 9AM to 10PM.

 

19.     The operation of drones is not allowed on the grounds or in the airspace of Hale Ono Loa.

 

POOL USE

 

1. The pool area (pool, shuffleboard, BBQ, etc.) is for the EXCLUSIVE USE of Hale Ono Loa occupants and guests.  The pool area is open from 9AM to 10PM daily.

 

2. Hale Ono Loa is a family-oriented complex and we ask that occupants and guests wear bathing suits with this in mind.  Topless sunning or bathing (females) is not allowed.

 

3. Some details of Pool use

a.     Nude bathing is not allowed, regardless of age. (NO EXCEPTIONS)

b.     For hygienic reasons, children who are not toilet trained must wear protective outwear.

c.      Owners, Tenants and Guests are responsible for the safety and conduct of their family members and guests.

d.     No screaming, loud behavior, pushing, running, fighting, etc. will be permitted.

e.     Lifeguard services are not provided. During pool use and use of shuffleboard, all children under the age of 12 years must be accompanied by a responsible adult.

f.       ABSOLUTELY NO GLASS IN OR AROUND THE POOL.

g.     The pool game “Marco Polo” is prohibited.

 

4. All persons known to be afflicted with an infectious disease, suffering from a cough, cold or sores displaying discharge shall not use the pool.  Spitting or spouting of water, blowing of the nose in the pool, etc. is strictly prohibited.

 

5.     For the safety of all, please assure that the pool gates are closed and locked when entering and leaving the pool area.

 

6.     A restroom is provided off the lobby in the Napili wing.  The pool key opens that door.

 

BUILDINGS AND OTHER MODIFICATIONS

 

1.  Unless the Board gives advance approval in each instance, occupants shall not install or operate on the premises any machinery or electrical apparatus not classified as a household appliance.

 

2.  Absolutely no air conditioners are to be installed or operated without being approved at a regular annual meeting of the Owners Association.

 

3.  No storage and/or use of any flammable or explosive material not classified as a household product is permitted.

 

4. Draperies, curtains or other material placed against any windows or doors visible from the exterior shall be in the color range from white to dark brown.

 

5.  Lanai sunshades must be in the color range from tan to dark brown and well cared for.  The shades must be pulled up and secured at night.  The Resident Manager reserves the right to remove damaged or worn out shades.


6.  Washing machines or dryers are not allow in the unit.
